Kodak Black Sentenced To 46 Months In Prison for 'Making False Statements'

4th Annual TIDAL X: Brooklyn - Arrivals

Rapper Kodak Black caught a break today (11/12) after receiving a shorter prison sentence form a Miami federal judge.

According to a tweet by the Miami ATF, "Bill K. Kapri, a/k/a “Kodak Black,” a/k/a “Dieuson Octave” is sentenced for knowingly making false statements in order to unlawfully acquire firearms".

Kodak, 22, of Pompano Beach, Florida, was sentenced today by U.S. District Judge to 46 months in prison, to be followed by 3 years of supervised release - far less than the maximum 10-year recommended sentence he could have received. The government argued Kodak be sentenced to 8 years, alleging he was involved in a prison fight that left one prison guard in a hospital. The judge rejected that recommendation.

Kapri previously pled guilty to knowingly making false and fictitious written statements in connection with the acquisition and attempted acquisition of firearms from a federally licensed firearms dealer..

According to court record, Kodak Black completed ATF Form 4473 on January 25, 2019 and March 1, 2019. On both occasions, Kapri answered “No” when asked, “Are you under indictment or information in any court for a felony, or any other crime for which the judge could imprison you for more than one year?”

On both occasions, as Kapri then and there well knew, Kapri was, in truth and in fact, under indictment for a felony offense. On January 25, 2019, Kapri transposed several digits of his social security number and thus was able to pick up three firearms on February 1, 2019. On March 1, 2019, Kapri used his true social security number and, as a result, was not permitted to pick up a fourth firearm.
